Will the Tesla Roadster Be Street Legal? The US and UK Rules Explained

By Samveg Jain·18 October 2026·Updated ·5 min read

Quick answer

Not yet. Coverage of Tesla's spec sheet says the new Roadster is not approved for public roads at this stage. A road car must meet safety standards before sale (FMVSS in the US, type approval in the UK), and thrusters that push a car off the ground are something regulators have not approved before. The Performance version, without listed thrusters, has the simplest path.

A quiet empty road crosses a flat rural landscape beneath low mist and soft dawn light.

Road legality must be established for the specific Roadster version, market and equipment supplied. A closed-site demonstration does not establish permission for the same manoeuvre or feature on a public road.

What Tesla has said

Coverage of Tesla's published specs, including the original specification report, says the Roadster is not approved for public roads at this stage, and the Rocket version is not offered in all regions. Before the event, reporting also pointed out that approval and safety certification for a thruster-equipped car are unresolved in the US, and that the system could face challenges for road approval in Europe.

That is not unusual for a car that is one to two years from production. Most cars are certified close to launch. The unusual part is the hardware.

Why each version is a different question

VersionHardwareRoad approval outlook
PerformanceNo thrusters listed in Tesla's specsClosest to a normal supercar; standard approval path
ThrustRear cold gas thrustersUnclear; thrusters are new territory for regulators
RocketThrusters around the car, one seatLeast likely to be road legal everywhere; invite only

This table is our reading of the published specs and the rules, not an official Tesla position.

How approval works in the US

In the US, there is no government pre-approval test for each model. Manufacturers certify that a car meets the Federal Motor Vehicle Safety Standards (FMVSS) set by NHTSA, covering crash protection, lighting, brakes, mirrors, seat belts and more. NHTSA can investigate and order recalls. Low-volume manufacturers can apply for limited exemptions. Some states also have their own equipment rules. A system that releases pressurized gas and can lift the car is not described by any current standard, so it would likely need disabling on public roads, an exemption, or new guidance.

How approval works in the UK

In the UK, a car needs approval before it can be registered, overseen by the Vehicle Certification Agency. Large manufacturers use type approval; low-volume and individual vehicle approval routes exist for small production runs and imports. Supercars sold in small numbers often use these routes. A left-hand-drive car can be registered, but Tesla has not said whether a right-hand-drive Roadster will be made. For UK pricing and ordering, see our Tesla Roadster UK guide.

A likely outcome

The most realistic picture is a road-legal Performance version, with thruster features restricted to closed courses or private property, or limited to certain markets. That is how some track-focused hypercars are sold today. Until Tesla confirms, treat any "flying on the highway" claims with caution.

Approval attaches to a defined vehicle

When a manufacturer describes a planned version, ask what configuration any approval statement covers. A change to equipment or software-controlled functions may raise a different question from the basic vehicle's eligibility for registration. It is unsafe to treat an approval headline as covering every feature shown in promotional footage.

This distinction also matters for imports. A vehicle supplied in one country may need additional documents or work before registration elsewhere. Obtain advice from the relevant transport authority or a qualified approval specialist about the actual vehicle and destination, rather than relying on another owner's experience with a different car.

Registration and permitted use are separate checks

Being able to register a vehicle does not grant permission to use every function in every setting. Public-road conduct, insurance conditions and any equipment restrictions still matter. Private land and a closed test site also have safety and permission requirements; they are not a blanket exception to responsibility.

Before paying for unusual equipment, ask for its operating instructions and the written description of where it may be used. Ask whether restrictions are enforced through the supplied configuration and who may change it. Do not infer the answers from the fact that an invited driver demonstrated a feature.

Documents a buyer should request

Keep the final specification, the applicable approval information, registration paperwork and insurer's written response together. Check that each document identifies the same version and market. If one refers to a different configuration, ask for clarification before treating the paperwork as complete.

For future updates, prefer an explicit approval statement with scope over predictions such as should pass or expected to qualify. The original coverage includes discussion of possible outcomes, but those remain interpretations. Only current official information can resolve the legal position. This article provides general context and adds no new legal rule or claim that a Roadster version has received approval. For an individual purchase or import, professional advice should be based on the documents offered to you.

Frequently asked questions

Does approval in one country settle approval elsewhere?

No. Check the destination authority’s requirements for the exact vehicle and configuration. Do not treat a foreign registration or another owner’s import as a complete answer.

Does a private test site remove every restriction?

No. Site permission, safety arrangements and applicable rules still matter. A closed-site demonstration is not permission for an owner to repeat a manoeuvre elsewhere.

What if the approval document names a different version?

Ask for clarification before relying on it. Specification, approval, insurance and registration documents should refer to the vehicle and equipment you intend to use.

Would an insurance quote prove the car is approved?

No. Insurance terms and approval documents answer different questions. Confirm both for the exact configuration and intended use before arranging registration or driving.
